WRONGFUL DEATH —

We Help Families Seek Justice After a Preventable Death

Nothing can make up for losing someone you love. But when a death was caused by a careless driver, a trucking company or an unsafe property, Louisiana law gives families a way to hold the responsible party accountable and to recover for the financial and personal losses that follow.

Stephen J. Hecker handles wrongful death cases with care and patience. We take on the insurance companies and the legal work so your family can grieve.

Two Kinds of Claims in Louisiana

  • Wrongful death action. This is the family’s own claim for their losses, such as loss of love, companionship and support, funeral and burial expenses, and the loss of the income and services the person would have provided.
  • Survival action. This is the claim the person who died would have had if they had lived, such as their pain and suffering before death, medical bills and lost earnings. The family brings it on their behalf.

Who Can Bring a Wrongful Death Claim?

Louisiana law sets an order of who may bring these claims:

  1. The surviving spouse and/or children
  2. If there are none, the surviving parents
  3. If there are none, the surviving brothers and sisters
  4. If there are none, the surviving grandparents

Adopted family members count. Family situations can be complicated, and we can help sort out who has the right to bring the claim.

Common Causes of Wrongful Death Cases

  • Car, truck and motorcycle crashes
  • Pedestrian and bicycle accidents
  • Drunk and impaired drivers
  • Bus and rideshare crashes
  • Unsafe property conditions
